Photo & Video Terms & Conditions

Payment and Booking Fee

 

A completed booking form (online) and the Booking Fee is payable to secure The Photographers services for The Clients date. The Booking Fee will be deducted from your total balance, this fee is non-refundable. The remaining balance will then be payable 45 days before the wedding. In the event that The Client fails to pay the remaining balance within fourteen (14) days of the wedding date, The Photographer may, at their discretion, treat this agreement as if terminated by The Client. Upon payment of the Booking Fee, The Photographer will reserve the event date on behalf of The Client(s) and reject all other requests for event coverage on that date. Thus, if for any reason the wedding is cancelled or postponed, all monies paid are non-refundable but may be transferable to a new date at our discretion. To reserve a new date a new Booking Fee will be required at the current rate.

 

The non-refundable booking fee of 25% of the total fee which is deducted from the total. Payment to be made via BACS transfer or debit/credit card, Cash and Cheques are not accepted, neither is the use of PayPal. Bank details can be found on your invoice along with a card payment link.

 

A direct debit scheme can be set up to help you manage payments, these will be setup over the number of months prior to 60 days before your wedding day, less any deposit paid - there is no charge for this option.

 

The booking fee for aerial services (if booked alone) is set at £75.00 - please note the conditions relating to provision of aerial services.

 

Upon receipt of the booking fee it shall be taken that the client has agreed to the terms laid out in these terms.

 

 

 

Cancellation

 

The Client may cancel this contract at any time after it has been signed by sending written notice (via email or post) to The Photographer. If the written notification is received more than 180 days before the date the wedding is due to take place then The Photographer will reimburse The Client any monies paid, except for the Booking Fee.

 

If the written notice of cancellation is received within 180 days of the due wedding date then the amount of the fee that The Photographer shall be entitled to is calculated in accordance with the table below (detailing the amount The Photographer is entitled to)

 

After 180 days - 40% of the agreed fee

Between 120 and 90 days - 60% of the agreed fee

Between 90 and 30 days - 80% of the agreed fee

30 days or less - 100% of the agreed fee

 

Where possible, if the client opts to move their wedding date the booking will be moved at no charge, if this is not possible then the above fees will be payable by the client except for exceptional circumstances.

 

Delivery

 

While every reasonable effort will be made to produce and deliver the agreed video/photos of the event, The Photographer’s entire liability to The Client for any claim arising from The Photographer’s performance or agents and servants (including photographers, processing laboratories and postal and delivery agents) is limited to a refund to The Client of the amount paid for services. 

 

The primary photographer for the wedding will be Adam Prescott, part or all of the filming on the day may be carried out (at The Photographers choosing) by a sub contracted cameraman of the same skill level.

 

If The Photographer is involved in an event rendering him unconscious, liability is limited to a full refund of monies paid. In the unlikely event of photographic equipment failure, the limit of liability for a partial loss of originals shall be a prorated amount of the footage lost based on the percentage of total time filmed.

 

In the unlikely event of personal illness, Acts of God, or other circumstances beyond the control of The Photographer, a substitute photographer of similar qualifications may be sent to fulfil the obligations of The Photographer herein contracted.

 

Where stated, the delivery timeframes are subject to change in cases where circumstances out of the photographers control impacts on the editing process, this may include volume of work. Where agreed these timescales may be extended.

 

There is no upper or lower number of images agreed by this contract, the number delivered will be contingent on the events of the day and the number of images delivered will be deemed as correct - an indication of the average number of images suppled on a normal wedding day will be indicated but he photographer at the time of booking, or by the client viewing completed wedding galleries.

 

The length of any wedding film will be within the parameters shown on the invoice.

 

 

 

Creative Licence

 

The Photographer shall be granted creative and artistic license in relation to the choice of locations and poses used. Judgement on photographic style and the length of footage shot and delivered shall be deemed correct. Whilst every attempt is made to provide the finished video in line with the times provided on the invoice, these are meant as a guideline and where it is not possible to provide a video which falls within the quoted time an explanation will be given although this will not be seen as a breech on contract.

 

On its own behalf, and behalf of the subject, Client acknowledges that it is familiar with the Photographer's portfolio and is requesting services with the knowledge of the Photographer's style, that Photographer's work is constantly evolving, that Photographer's services are of unique and artistic nature, that the photos/videos may be different from photographs/videos taken by the Photographer in the past, and that in creating the photos/video, the Photographer shall use its artistic judgement to create images consistent with its personal vision of the event, which vision may be different than the Client's and/or subject's vision of the event. Accordingly, the Client acknowledges that the photos/videos shall not be subject to rejection on the basis of taste or aesthetic criteria. The final post-production and editing styles, effects, and overall look of the images/videos are left to the discretion of the Photographer.

 

The photographer will endeavour to take shoot all the footage agreed. However, because a wedding is an uncontrolled event, the photographer cannot guarantee delivery of any specifically requested image(s), especially if timings or events are altered without our knowledge. Due to changes of the weather and the availability and willingness of subjects The Photographer will do their best to honour requested footage but cannot undertake to guarantee any specific picture nor incorporate any specific background, location or group arrangement.

 

During a wedding The Photographer will automatically re-take any footage where they have seen that someone has spoilt the shot, but it is impossible to guarantee to see them all. The more people in the footage the more difficult it is to see everyone.

 

The Photographer will provide a pleasing colour balance but cannot guarantee exact colour matching. Owing to anomalous reflectance caused by a combination of certain dyes and materials, especially man-made fibres, it is sometimes impossible to record on film/digital media the exact colour of materials as seen by the human eye.

 

Where audio is required to be recorded such as during the ceremony and speeches, those participants involved may be requested to wear a wireless microphone or recorder to capture the audio, if the participant refuses to wear, moves or otherwise adjusts the apparatus once fitted by photographer which affects the quality of the audio recording gain - the photographer cannot be held responsible. Likewise, should an unexpected event occur which affects the audio quality unduly the photographer cannot be held responsible.

 

Any additional editing and/or retouching will be subject to an hourly rate of £45 per hour. Retouching includes but is not limited to additional skin softening/smoothing, correction of hair/makeup/clothing, swapping a face from one image to another, environmental effects, reflections in glasses, teeth whitening, brightening of eyes, and bodily enhancements.

 

 

 

Re-editing - Video

 

The Photographer will produce the first version of the film based on the information provided by the couple during the booking process. The couple are entitled to one set of revisions to this film which are limited to minor adjustments to the content and does not include a completely new edit. Further changes may be requested and editing time is then chargeable at £45 per hour or part thereof.

 

Any changes must be notified within 7 days of receiving the film, any changes outside this time will be subject to a revision fee - this is due to the hosting company charges to re-upload your film. These charges are currently set at £5.00 per GB uploaded.

 

Photo

 

The images provided by the photographer will be those which represent the day to the fullest, where a black and white image is provided the colour version will also be provided, distracting items such as light switches, fire exit signs will be removed as standard if they compromise the overall image.. Should the client wish any further images edited, items / people removed, images changed to black and white etc this will be subject to a £35 per hour charge.

 

 

 

House Rules

 

The guidelines of the ceremony official and the reception site management limit The Photographer. The Client agrees to accept the technical results of their imposition on The Photographer. Negotiation with the officials for moderation of guidelines is The Client’s responsibility; The Photographer will offer technical recommendations only.

 

Group shots are generally limited to the ‘bridal party’ and both partners immediate family - eg parents, grand parents and siblings. 

 

Should The Photographer be in attendance for over 4 hours then access to a meal and beverages must be provided to The Photographer and any subcontractors who may be in attendance.

 

 

Exclusivity

 

The Photographer shall be the sole professional (moving or still image) photographer(s) at the venues specified, unless agreed prior to the day with The Photographer - this includes content creators.  In the event that the couple have employed a content creator, this will be allowed on the strict understanding that they are the solely to capture behind the scenes footage, and will take a secondary role with priority being given to the photographer at all times and will in no way delay or hinder the photographer during the day.

Should the venue or other vendors request to provide their own content creator / photographer / videographer this must be discuss with ourselves prior to any agreement.

 

 

Files

 

Once a set of high resolution digital files have been delivered, the responsibility to preserve the images passes to The Client. The Photographer will keep a copy for no more than 1 year of the RAW files, and for no more than 2 years for the edited films.

 

If your photography product is delivered via an online gallery, this will remain active for 12 months are it is delivered, the client may choose to extend this time period - there is a £60 PA charge for this.

 

If your videography product is delivered via online gallery, in the first 12 months after delivery you will be able to download the videos, following this it will become a view only gallery for the next 12 months.

 

The RAW files (video only) filmed on the day are available to the client should they wish for a fee of £800, and that the client provides suitable media to transfer these files onto, and that they are not used by a further photographer or for commercial gain.

 

Albums & Prints - if a wedding album or prints are included in the chosen package, image selections for the album must be completed within 3 months of the final gallery being delivered. 

 

 

 

Copyright

 

The 1988 Copyright Act assigns the copyright to the photographer. It is contrary to the Act and strictly illegal to copy or allow to be copied, any of the footage covered by this contract. The Photographer grants The Client permission to make copies of the footage under the conditions that the footage taken by the Photographer are for personal use by The Client and their friends and relatives. 

 

Sale, Publication or any Commercial use of the photographs is not allowed without prior written permission from The Photographer and the appropriate rights assignment fee being paid.

 

Where the client allows other parties to use the images supplied (to vendors etc) those vendors must credit the photographer whenever the images / video is used.

 

 

 

Consent Form for Photography/Filming

 

We/I consent to Adam Prescott Photography using photographs and/or video recordings including images of us/me both internally and externally to promote Adam Prescott Photography. These images could be used in print and digital media formats including print publications, websites, e-marketing, advertising, film and social media purposes.

 

We/I understand that images on websites can be viewed throughout the world and not just in the United Kingdom, and that some overseas countries may not provide the same level of protection to the rights of individuals as EU/UK legislation provides. 

 

We/I understand that some images or recordings may be kept permanently once they are published and be kept as an archive of photographic works completed.

 

We/I have read and understand the conditions and consent to our/my images being used as described. This is not contractual and you are free not to sign this consent.

 

Adam Prescott Photography Ltd is committed to processing information in accordance with the General Data Protection Regulation (GDPR). The personal data collected on this form will be held securely and will only be used for administrative purposes.

 

In general terms only images of the couple will be used, but is understood that some group shots may also be used as a legitimate interest to promote Adam Prescott Photography Ltd.

 

Images of any person clearly under the age of 13 will not be used in print or digital media format including print publications, websites, e-marketing, advertising, film or social media. Should any member of your wedding/event not wish for their image to be used or taken they should advise the photographer on the day. 

 

 

Your rights

 

You have the right to request to see a copy of the information we hold about you and to request corrections or deletions of the information that is no longer required. You can ask the Adam Prescott Photography to stop using your images at any time, in which case it will not be used in future publications but may continue to appear in publications already in circulation. 

 

You have the right to lodge a complaint against Adam Prescott Photography regarding data protection issues with the Information Commissioner’s Office (https://ico.org.uk/concerns/).

Aerial Services

 

All aerial work is only confirmed, subject to a risk assessment and flight plan being completed. The cost of these is taken upon booking and is included in the overall fee. Should a flight found to not be possible at the planning stage 50% of the booking fee will be refunded.

 

If on the day, the pilot deems the conditions to be too dangerous to fly (weather / other air traffic) then you will be entitled to a 50% refund of the overall fee (if it is solely aerial service which have been booked)
